QEMTO TERMS OF SERVICE

Welcome to QEMTO. The terms “we,” “us,” and “our” refer to QEMTO, the trading name used for this online store.

QEMTO operates this website and provides its related information, content, products, features, and services to offer customers a curated online shopping experience (the “Services”). Our store is powered by Shopify.

Product measurements are approximate unless otherwise stated. Minor variations that do not materially affect the product may occur.

Nothing in this section limits any rights available to consumers under applicable law.

SECTION 3 — ORDERS

Submitting an order constitutes an offer to purchase the selected products.

An order is accepted after payment has been authorized and we send an order confirmation. We reserve the right to reject or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Suspected fraud or unauthorized payment

  • Incorrect pricing or product information

  • Delivery restrictions

  • Violation of these Terms

If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

Products purchased through our store are intended for personal use and not for unauthorized commercial resale.

SECTION 4 — PRICES, TAXES, AND PAYMENT

Prices may change without prior notice. The price charged will be the price displayed when the order is placed.

Applicable taxes, shipping costs, and other charges will be displayed before the customer completes payment whenever required.

International orders may be subject to customs duties, import taxes, or other charges imposed by the destination country. Where these charges are not collected at checkout, the customer may be responsible for paying them to the relevant authority or delivery carrier.

You agree to provide complete and accurate billing and payment information. You confirm that you are authorized to use the selected payment method.

All payments are processed through secure third-party payment providers. QEMTO does not directly store complete payment card details.

SECTION 5 — SHIPPING AND DELIVERY

Delivery dates are estimates unless expressly stated otherwise. Delays may occur because of customs inspections, carrier disruptions, weather, holidays, incorrect delivery information, or events outside our reasonable control.

Nothing in these Terms transfers the risk of loss to a consumer before the customer, or a person designated by the customer, receives physical possession of the goods where applicable consumer law provides otherwise.

SECTION 6 — RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, exchanges, damaged products, and cancellation requests are handled according to our Return, Refund and Cancellation Policy:

Approved returns are sent to our return facility in Israel. The complete return address and instructions are provided after a return request is approved.

The published policy does not limit any mandatory consumer rights available under applicable law.

SECTION 7 — PROMOTIONS AND DISCOUNTS

Promotions, discount codes, and special offers may be subject to separate conditions.

Unless otherwise stated:

  • Discount codes cannot be combined

  • Discounts cannot be applied retroactively

  • Promotional offers may have expiration dates

  • Promotions may be limited to specific products, customers, or regions

We reserve the right to cancel or correct a promotion affected by an error, fraud, or misuse.

Shopify’s name, logo, products, and services are the property of Shopify or its licensors.

SECTION 9 — THIRD-PARTY TOOLS AND LINKS

The Services may contain tools, applications, integrations, or links operated by third parties.

We do not control third-party services and are not responsible for their content, security, availability, or privacy practices.

Before using a third-party service or completing a transaction with a third party, review its applicable terms and privacy policy.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

QEMTO is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

Purchases made through this store are transactions directly between the customer and QEMTO. Shopify is not the seller of QEMTO products and is not responsible for the fulfillment, quality, safety, return, or refund of products purchased from QEMTO.

If you submit a review, photograph, suggestion, comment, or other content to us, you confirm that:

  • You created the content or have permission to submit it

You grant QEMTO a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, translate, and display submitted content for operating and promoting the Services, subject to applicable privacy and consumer protection laws.

We may remove content that violates these Terms. We are not obligated to publish or respond to every submission.

SECTION 13 — ERRORS AND INACCURACIES

Occasionally, the Services may contain errors or omissions relating to product descriptions, prices, promotions, availability, delivery times, or other information.

We may correct such errors and update information when necessary.

If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

We provide the Services with reasonable care and aim to ensure that products conform to their descriptions.

To the fullest extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free, or available.

Nothing in these Terms excludes or limits any statutory warranty, legal guarantee, right of withdrawal, or other mandatory consumer right that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, QEMTO will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the customer entered into the purchase contract.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for:

  • Fraud or fraudulent misrepresentation

  • Intentional misconduct or gross negligence

  • Death or personal injury caused by negligence

  • Breach of mandatory consumer rights

  • Any other liability that cannot lawfully be excluded

SECTION 17 — TERMINATION

We may suspend or terminate access to the Services if a user materially violates these Terms, engages in fraud, compromises website security, or uses the Services unlawfully.

Termination does not affect rights and obligations that arose before termination, including payment obligations, intellectual property rights, and provisions that are intended to survive.

SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

SECTION 19 — ENTIRE AGREEMENT

These Terms, together with the policies referenced in them, constitute the agreement governing use of the Services and purchases made through the store.

Failure to enforce a provision does not waive our right to enforce it later.

SECTION 20 — GOVERNING LAW AND CONSUMER PROTECTION

These Terms are governed by the laws applicable in Italy, without excluding mandatory consumer protections available under the laws of the customer’s country of residence.

Nothing in these Terms prevents a consumer from using any court, dispute resolution process, or consumer protection right available under applicable mandatory law.
